Terms and Conditions of Sale

These General Terms and Conditions of Sale (GTC) govern sales concluded on the ZAYVEO website between KOBINA Nicholas, a sole proprietorship, and any consumer wishing to make a purchase via the site.

2. Products

ZAYVEO offers aroma diffusers and ambiance accessories. Products are described and presented with the greatest possible accuracy. Minor variations in appearance (wood tone, slight differences in finish) may exist between photographs and the received product, without constituting a defect of conformity.

The seller operates on a made-to-order (dropshipping) model: products are shipped directly from the warehouses of our logistics partners, located outside the European Union. The seller remains solely responsible for the proper execution of the order, product conformity, and after-sales service, regardless of the shipping location.

3. Prices

Prices are indicated in euros (VAT not applicable — art. 293 B of the CGI). The current price is the one displayed on the product page at the time of order confirmation.

The seller reserves the right to modify its prices at any time. Only the price in effect at the time of order confirmation applies.

Customs fees: products are delivered with VAT included, which is collected upstream by our shipping platform. No additional fees should be claimed from the customer upon delivery under normal conditions.

4. Order

The order is validated after payment confirmation. A summary email is sent to the address provided by the customer. The seller reserves the right to cancel or refuse any order from a customer with whom there is a dispute regarding the payment of a previous order, or in case of product unavailability.

5. Payment

Payment is made online, at the time of order, by credit card or any other means offered on the site via Shopify Payments. Transactions are secured. The seller does not have access to any of the customer's banking data.

6. Delivery

Standard delivery is free in mainland France, with no minimum purchase amount. The applicable delivery times and rates are as follows:

In accordance with article L216-2 of the Consumer Code, if the announced delivery time is exceeded, the customer may request cancellation of the order under the conditions provided by law.

The seller cannot be held responsible for delays attributable to the carrier or circumstances beyond their control (customs, strikes, force majeure).

7. Right of Withdrawal

In accordance with articles L221-18 and following of the Consumer Code, the customer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to provide any reason.

8. Legal Guarantees

All products sold benefit, by right and without additional cost, from:

  • the legal guarantee of conformity (articles L217-3 and following of the Consumer Code);
  • the legal guarantee against hidden defects (articles 1641 and following of the Civil Code).

In case of non-conformity or hidden defect, the customer can contact the seller at nkobina@icloud.com to obtain repair, replacement, or refund of the product, free of charge.

9. Liability

The seller cannot be held responsible for the non-performance of the contract in case of force majeure, stock shortage at the supplier, or total or partial disruption or strike of postal services and means of transport.

10. Personal Data

The processing of personal data collected during the order is described in our privacy policy.

11. Consumer Mediation

In accordance with article L612-1 of the Consumer Code, any consumer has the right to free recourse to a consumer mediator for the amicable resolution of a dispute.

12. Applicable Law and Disputes

These GTC are subject to French law. In case of dispute, an amicable solution will be sought before any legal action. Failing amicable agreement, the competent French courts will have sole jurisdiction, subject to the mandatory rules of jurisdiction applicable to consumer disputes.
